What is neonatal care leave and pay?
Neonatal care leave and pay is a new statutory entitlement introduced in April 2025. It gives eligible parents time off when their baby requires specialist neonatal care after birth. It supports families during difficult and unexpected hospital stays.
Who is eligible?
Employees are eligible if their baby is admitted to hospital before 28 days old and remains in care for at least 7 continuous days. Eligibility also depends on their employment status and length of service. Leave is available to both parents.
How much leave can be taken?
Eligible employees can take up to 12 weeks of neonatal care leave, depending on how long their baby is in hospital. This is in addition to maternity, paternity, and shared parental leave. The leave must be used within 68 weeks of the birth.
Is the leave paid?
Yes, if the employee meets qualifying conditions, they may be entitled to Statutory Neonatal Care Pay. This is paid at the same rate as Statutory Paternity Pay and subject to usual eligibility criteria, including earnings thresholds and length of service.
How should managers respond to requests?
Handle requests with empathy and discretion. Encourage employees to speak openly and submit documentation where needed. You may need to liaise with HR or payroll to confirm eligibility and calculate entitlements.
Supporting the employee
This is a sensitive and often stressful time for the employee. Be mindful of emotional wellbeing. Offer flexible working where possible and signpost any internal wellbeing support services. Keep in touch appropriately while leave is being taken.
Record-keeping and communication
Ensure accurate leave and pay records are kept. Confirm leave arrangements in writing and agree how the employee would like to stay in contact. Avoid unnecessary pressure or requests for updates that may cause stress during this time.
